I am not a lawyer but I have read something about water being an attractant. Your float could be what a lawyer would say caused the child to go into the water. But a child that gets out is better than one that drowns.

I don't have banks that are so steep that a child or adult can't walk out of he pond.

Yes. I think they sometimes claim ponds are an attractive nuisance and increase liability. Maybe instead of ducks and normal looking floats, we should put those floating alligator heads replicas out there. Serve as deterence and a float...

I too think it is best not to have too steep a drop off near bank.
