I just bought a piece of property in west virginia with a spring on it and would like to create a pond. Will I need a permit for that?

Hey, twright, welcome to Pond Boss from a fellow Mountaineer! There may be some county by county rules on this, so you need to check into it. I am about to dig into the issue myself and would be happy to share the info I find with you.

Just remember that if the spring is in the pond basin, and gets covered up with water, the water can flow into the spring also..... It all depends on what has more pressure, the Spring, or the pond. That might vary with the time of year - less pressure in late summer in the spring when the weather is drier out.

As for the needs for permits, it does depend. In most cases, you don't need one, but ....
Give a call to my friend Dr. Ken Semmens at 304-293-2657, or send an e-mail to ken.semmens@wvu.edu. Ken is the head aquaculturist for the WV Extension Service. If you do need permits because of your location or other special needs, he can put you in touch with the proper regulatory people. Just tell him that Ken G. from Pond Boss referred you.
