Does the stream actually run on your property across the corner above the pond elevation as your topo drawing indicates? Is it constant or seasonal? Not sure of the regulations in NY but if it is constant and legal the water could be piped to the pond site and then overflowed via pipe back to the creek down below. If your soil holds water it looks like you have plenty of runoff to increase the pond by raising the dam as Theo stated. If this pond is spring fed and the water table is at the present pool level of the pond then you will need to excavate the pond. It looks like the grass is very lush and green below and behind the pond site. Did you look at that area and see any signs of wetted soil or marsh? If there is no historical info about the pond and you want to find out if it is spring fed or a runoff sealed pond, pump it dry or way down. If it refills in a day or so theres your answer.... looks like a nice property good luck.
