Thanks for the replies and support everyone. I poked in quickly over the weekend but had nothing much to report. 35mm camera pics have been and more will be taken. The Rome GA Dept. is the ones who did the original survey, thanks for the direct link.
We have been in contact with a lawyer who suggested we stay a bit more mum on the issue. Also that no permits have been filed, no surveys done. And until they do anything nextdoor we have to wait to see what happens.
I will come back and update this thread in the future.

Rip Tide,
Now may be a good time to have your local NRCS Agent come out and "assist" you with a pond evaluation...perhaps that could valuable in the future as they could attest to the condition of your pond - goodness forbid if anything happen to it?

I can recite the Georgia rules, and most of the ACoE rules backwards in my sleep. He cannot change the point of egress where the water leaves his property and enters yours. Period. It should be a last resort, but if you are sure you are legal, threaten him with the ACoE. Follow through only if you have to.
