Oh gosh, even to my untrained eye that dam looks fit to wash out in the next big rain. Get some plants growing on that pronto! The spillway needs to be able to handle a lot more water and should be a few inches lower to give you more freeboard as a safety precaution. It already looks to have gone over the top once or twice.
