I do it often, when the creek has water. It usually doesn't have water flowing from July or August through October. In most non-western states of the USA, you are allowed to pump water for personal use if the creek is on your land. It's unlimited here from a non "blue line" (intermittent) stream. I would be allowed to pump an acre foot a year without a permit from a "blue line" permanent stream. I have never heard of any enforcement in high rainfall states for personal use as for a farm pond. It depends on local regs, but I think in your state, with water not scarce, there shouldn't be a problem.
