Sixth Circuit Issues Temporary, Nationwide Stay on WOTUS

"This morning (Oct 9, 2015), the United States Court of Appeals for the 6th Circuit issued a nationwide preliminary injunction preventing U.S. EPA and the U.S. Army Corps of Engineers (Corps) from implementing the WOTUS rule while the court is reviewing the various legal matters surrounding the regulation. In the ruling, Judge McKeague said, “the stay temporarily silences the whirlwind of confusion that springs from uncertainty about the requirements of the new Rule and whether they will survive legal testing.”

The motion for the preliminary injunction was filed by 18 states. The 6th Circuit decision follows a preliminary injunction issued August 28 by the U.S. District Court for North Dakota. The judge in that case clarified on September 4 that the injunction only applied to the 13 states that were plaintiffs to that litigation. One of the reasons the district court failed to issue a nationwide injunction was out of deference to the 6th Circuit, where many, but not all, of the legal challenges to the WOTUS rule have been consolidated by the U.S Judicial Panel on Multidistrict Litigation.

The legal challenges surrounding the WOTUS rule will continue to be played out in the courts, but today’s ruling is a very positive first step because it means that the rule cannot be implemented or enforced for the time being."

Finally got a debit card a few weeks ago. (Still don't have a cell phone LOL).

Anyway the merchant is identified on my online statement as POS. (Point of Sale) That's always meant something else to me! whistle

Well them I don't feel so far behind the times.

Spent two weeks on a fly in to northern Maine once. No electricity, no TV, no radio, no newspaper, no alarm clock, and no indoor latrine. Not even lights. Once it got dark you pretty much hit the hay, but you were ready to go at first light.

Anyway felt weird and boring the first day or so other than the thrill of fishing a new pond everday after a hike in the mountains. But the peaceful feeling was magnificent!

I love technology just as much as the next guy but it can be a monkey on our backs. I will say I ddn't spent much time in the outhouse. Not my cup of tea!

Even tho Cecil has his new debit card, he still thinks ya don't need money in the account ta use it. Words right out of his mouth.

It's that way with checks too Bob. As long as you have checks you have money! grin

Gotta say I like the debit card better. I hate it when it takes a month or more for a check to clear and I forget about it because it's five or six pages back in my register. Why do some businesses take so long to deposit a check?

Because most of them now receive payment-transactions with debit or credit cards.
Checks are no longer the norm with many businesses. Too many checks were rubbery. wink Cheaper for the vendor to pay a 2.5-3% card-service fee than to employ a person whose primary duty was to chase down bad-check funds - sometimes unsuccessfully.

That's a tradition here isn't it? :-)

Funny in the 30 plus years I've been in business I've only received one bad check and that was another business owner. Tried accepting credit cards but didn't get enough people that wanted to use one to make it worth the monthly fee. The straw that broke the camel's back was when a mail order customer did a charge back on me claiming he never got what he ordered. I had proof as his partner signed for the order, but the CC company refused to back me and told me to eat it. Said it it was part of doing business!

May try it again in the future though.

FWIW As a consumer, I prefer paying with PayPal when I can. It limits my exposure to providing credit card info on the internet when I purchase and it is a lot easier as I don't have to enter any info when I make an online purchase.

Same here but unfortunately not everyone accepts it. Amazon sure didn't and doesn't because eBay a competitor owned Pay Pal at one time.

As a business the only thing I don't like is it takes about 3 days for the money to be deposited in my checking account. My guess is someone's making interest money on that three day float.

I do like my debit card. And it's counterintuitive but I'm less likely to make mistakes in my register with a debit card vs. a check.

Bill I am a long time PayPaL fan too. I sometimes have actually done Google searches for an item using PayPaL in the search terms. Like if I was looking for a certain Kohler faucet, I search "Kohler Faucets PayPal" so only vendors that accept PayPaL appear in the results. PayPal is another reason I love Ebay shopping.
