We are buying a home with an existing pond, I would like to replace the current overflow pipe because it is a flawed design and keeps on clogging.... I was wondering if the pond freezing is a major concern for the new overflow pipe - basically was wondering what design features should be implemented to prevent the new overflow pipe from cracking from the ice.

My overflow on my biggest pond is one of those KISS models. It's technically what some call an "emergency overflow" in that it's a stone lined ditch on top of the ground. It quickly funnels into a culvert pipe that dumps into a highway ditch. If I want to keep fish out I stake in plastic cage material where the water first comes out of the pond.
My other three ponds are fed by a well with various underground gate valves to divert the water for filling what ever pond I chose. They are simply draining pipe (the corrugated black stuff) that pull above water level with a rope and a state if I want to halt outflow.
I've never had any problem with freezing.

If pigs could fly bacon would be harder to come by and there would be a lot of damaged trees.

dano, welcome to the forum! Have you looked into siphon systems? They pull water from further down the water column, and are less prone to clogging.
