Probably considered the same as some of the Berkley products like "crappie bites", "Gulp", "Gulp Alive", and "Powerbait". Some places banning bait for fishing may or may not allow it, depending on their interpretation, but it is definitely not live bait.

James, I thought I remembered something about scents and flies, so I checked TPWD and all scents are prohibited.
Not sure if that relates to your question about Stubby Steve's, but it might be worth checking out.

Not illegal, but the fly fishing world is pretty clear about lures other than actual, factual tied flies.
TPWD seems to prohibit any scents or live bait used for any state records or awards, while some other organizations will allow only a liquid scent on a traditional fly. In my pond, if you've got a fly rod big enough to throw cut squid, then throw it.
Since I didn't know the reason for James' question, I wanted to make sure he had as much info as possible. His fish are huge!!
